Applicability.
This regulation applies to all U.S. Army-owned and/orArmy-controlled laboratories and facilities that furnish or havecustody of or possession of biological select agents and toxins (asdescribed in app B) and their major commands, and, whenincorporated into the contract, Army contractors that are providedbiological select agents and toxins by the Department of the Army.This regulation is not applicable during full mobilization.
Purpose
This regulation prescribes policy, responsibilities, procedures,and minimum standards for safeguarding Army biological selectagents and toxins (BSAT) as defined in Part 73, Title 42, Code ofFederal Regulations (42 CFR 73).
This regulation—
(1) Establishes the physical security requirements for BSAT.(Prior to storing BSAT, organizations will request securityguidance through command channels from the Office of the ProvostMarshal General (DAPM–MPD–PS), 2800 Army Pentagon, Washington, DC20310–2800.)
(2) Does not abrogate or abridge the authority or responsibilityof a commander to apply more stringent security standards duringemergencies or at any time the threat to BSAT indicates additionalprotection measures are necessary.
(3) Prescribes physical security measures to properly safeguardBSAT against loss, theft, diversion, or unauthorized use oraccess.
The security provisions in this regulation apply only to BSAT;they are not applicable to other biological agents.
Biological security provisions in this regulation are notapplicable to recovered biological warfare material.
